Levine Staller Obtains $80,000 Settlement of Consumer Fraud Claim

John Hoffman recently obtained an $80,000.00 settlement for Atlantic County homeowners based upon alleged violations of the New Jersey Consumer Fraud Act against a South Jersey swimming pool contractor. Mr. Hoffman was able to obtain this excellent result without having to file suit. The parties and specific facts are subject to a confidentiality agreement.

The New Jersey Consumer Fraud Act (“CFA”), N.J.S.A. 56:8-1 to -20, was enacted  “to combat the increasingly widespread practice of defrauding the consumer.” Our Courts have held that its purpose is to “(1) compensate the victim for his or her actual loss; (2) punish the wrongdoer through the award of treble damages; and (3) attract competent counsel to counteract the ‘community scourge’ of fraud by providing an incentive for an attorney to take a case involving a minor loss to the individual.”
